1. Agreement to Terms

By accessing or using AccidentMap Pro ("AMP," "the Platform"), operated at accidentmap.pro, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

If you are using AMP on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

2. Description of Service

AMP is a collision analysis platform that generates structured PDF reports based on data you provide. Reports may include data collation, environmental context, physics-based analysis, fault determination rule assessment, vehicle damage analysis, and biomechanical exposure modeling, depending on the tier selected.

The Platform is intended for use by trained professionals (such as insurance adjusters, claims investigators, and legal professionals) who possess the appropriate domain knowledge to interpret analytical outputs in the context of their professional work.

3. Important Limitations of the Service

AMP is an analytical support tool. It is not a substitute for professional judgment, legal advice, medical diagnosis, or formal accident reconstruction. AMP does not provide expert opinions or formal accident reconstruction conclusions.

AMP indicates, models, surfaces, and supports. It does not determine liability, diagnose injuries, conclude fault, or replace the judgment of qualified professionals.

Reports generated by AMP are based on the data you enter and publicly available environmental data. The accuracy of any report depends on the accuracy and completeness of the inputs you provide. Outputs are generated using model-based calculations derived from published engineering standards and may not reflect actual collision dynamics or real-world outcomes in every case.

Fault Determination Rule (FDR) assessments identify and display applicable rules from Ontario Regulation 668 based on the collision scenario described. These assessments are informational. The determination of fault remains the responsibility of the adjuster, insurer, or other qualified decision-maker.

Biomechanical exposure modeling and injury risk indicators are based on published research and statistical models. They are not medical assessments. They should not be used to diagnose, treat, or make medical decisions about any individual.

Decision responsibility: The user retains full responsibility for all claims handling decisions, liability determinations, and professional outcomes arising from the use of AMP. The Platform does not make decisions and must not be relied upon as the sole basis for any professional, legal, medical, or claims determination.

You are solely responsible for verifying the information in any AMP report before relying on it in professional decisions, legal proceedings, or claims handling. Reports should not be relied upon as a sole basis for any professional, legal, or claims decision.

4. Account Registration

To use AMP, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials. You must notify us immediately at support@accidentmap.pro if you believe your account has been compromised.

You may not share your account credentials with others or allow others to access the Platform through your account. Each subscription or seat is for a single authorized user.

5. Acceptable Use

You agree to use AMP only for lawful professional purposes related to collision analysis, claims handling, or insurance operations. You agree not to:

Use the Platform for any purpose that violates applicable law or regulation. Attempt to access other users' data, accounts, or reports. Reverse-engineer, decompile, or attempt to extract the source code or algorithms of the Platform. Use automated tools (bots, scrapers, or similar) to access the Platform. Resell, redistribute, or sublicense access to the Platform or its reports without our written consent. Misrepresent AMP reports as formal accident reconstruction, engineering analysis, medical assessment, or expert opinion.

6. Pricing and Payment

AMP offers per-report pricing, monthly subscriptions, and annual subscriptions across three tiers (Basic, Standard, Premium). Current pricing is displayed on the Platform.

All new users receive one (1) free Basic report. After the free report, continued use requires a paid tier or per-report purchase.

Subscription fees are billed in advance on a monthly or annual basis. Per-report fees are charged at the time of report generation.

All fees are in Canadian dollars (CAD) unless otherwise stated. Prices are subject to change with 30 days notice to active subscribers.

Refunds for subscriptions are not provided for partial months. If you cancel a subscription, you retain access through the end of your current billing period.

7. Intellectual Property

The Platform, including its design, code, algorithms, analytical methodologies, and documentation, is the intellectual property of AccidentMap Pro. Our core methodology is patent pending.

Reports you generate are yours to use in your professional work. However, the report format, structure, analytical framework, and underlying methodology remain our intellectual property.

You may not reproduce, modify, or create derivative works based on the Platform or its analytical methodology.

8. Data Ownership and Privacy

You retain ownership of the collision data you enter into the Platform. We do not claim ownership of your data or your reports.

Our collection and use of your data is governed by our Privacy Policy, available at accidentmap.pro/privacy-policy/. By using the Platform, you consent to the practices described in the Privacy Policy.

You are responsible for ensuring that any data you enter into the Platform is collected and shared in compliance with applicable privacy laws and your own professional obligations.

9. Availability and Support

We strive to keep the Platform available at all times but do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We are not liable for any loss or damage resulting from Platform downtime or unavailability.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

AMP is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or accuracy.

AccidentMap Pro makes no representation or warranty that report outputs will reflect actual collision dynamics, real-world outcomes, or the conclusions that a qualified human expert would reach upon independent analysis of the same collision.

AccidentMap Pro is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to damages arising from incorrect report outputs, reliance on AMP data in claims handling or legal proceedings, or decisions made based on AMP reports.

Our total aggregate liability to you for any claims arising from your use of the Platform shall not exceed the total amount you have paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless AccidentMap Pro, its founders, employees, and contractors from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or any third-party claims related to your reliance on AMP reports in professional decisions.

12. Termination

You may close your account at any time by contacting support@accidentmap.pro or through the Privacy & Your Data page in your account dashboard.

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. We will provide reasonable notice where possible.

Upon termination, your access to the Platform and your reports will cease. We will delete your data in accordance with our Privacy Policy.

13. Modifications to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Platform at least 30 days before the changes take effect. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of the Platform shall be resolved in the courts of Ontario.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and AccidentMap Pro regarding your use of the Platform.
